Zoom Car Rental is in the business of facilitating vehicle rental services bookings. It is made expressly clear that Zoom Car Rental is not in the business of providing vehicle rental introductory services. Furthermore, Zoom Car Rental does not operate or own any vehicle rental services. Hence, any contract that is entered into will be between the rental vehicle provider and you. The terms and conditions that pertain to the rental agreement that is applicable between you and the rental vehicle provider can be accessed on this booking engine. This can be done after you select the type of vehicle and provide the needed information. However, Zoom Car Rental categorically states that it does not undertake any warranty or responsibility with regard to any rental vehicle provider. It doe not also undertake any responsibility or warranty regarding any vehicle that is taken on rent by any rental vehicle provider. The sole responsibility of providing you with a rental vehicle, that is rented using this booking engine, lies totally in the hands of the rental vehicle provider.
It may please be noted that whatever references that are made to booking engine in these Terms of Use should also be considered as references to all bookings made through Zoom Car Rental's call center.
Fees And Charges
If there is any credit card or administration charge is levied by Zoom Car Rental, the same is non-refundable under any circumstances. Hence, it is the sole responsibility of the rental vehicle provider to ensure that your reservation for car rentals is processed correctly. It may also be noted that the correctness and accuracy of any quotation for the purpose of renting a vehicle would totally depend on the details provided by you on this booking engine and Zoom Car Rental would not be liable in any manner for wrong information provided by you.
Service Access
While it will be the endeavor of Zoom Car Rental to provide round the clock availability of the booking engine for all the 24 hours each day, Zoom Car Rental will not be in manner be liable for stoppage of booking engine facilities for reasons which are beyond the control of Zoom Car Rental. Access to booking engine could be temporarily suspended due to system failure, repair, maintenance or any other reasons that are beyond the direct and indirect control of Zoom Car Rental.
Liability
Should there be any dispute between Zoom Car Rental and you, our liability to you would be limited to the equivalent of the amount paid by you as introductory service fee, when booking the vehicle.
Zoom Car Rental by this Terms of Use excludes to the fullest extent as permitted by law, any warranties, implied or express, regarding the quality, performance, completeness or fitness for a particular purpose of (i) booking of any vehicle using this booking engine and (ii) the contents in this booking engine, including, but not limited to, information that is related to vehicle rental which is a part of this booking engine and also the technology that is supporting this booking engine. Zoom Car Rental holds complete right to effect alterations and changes to the booking engine at any time without prior notice. It has to be noted that the information available in this booking engine is subject to regular update. When you are using the information contained in this booking engine, you acknowledge and agree that all the rental details and other information including, but not limited to, travel and holidays may include typographical errors or inaccuracies that are inadvertent in nature.
Any booking arrangement that you enter into for vehicle rental on this booking engine is made only with a rental vehicle provider and not with Zoom Car Rental. The only job of Zoom Car Rental is to help in making of reservations with the rental vehicle provider. Zoom Car Rental is no way a party to the contract between the rental vehicle provider you and it has no responsibility or direct or indirect liability to any person in any manner whatsoever. If there is any problem arising out of your terms of contract between the rental vehicle providers or because of the rented vehicle pursuant to that contract, Zoom Car Rental is in no way responsible. After you have made a booking for a vehicle rental using the services of this booking engine, it is deemed that you have accepted the terms and conditions laid down by the rental vehicle provider.
EXCEPT TO THE EXTENT OF ACTIONS WHICH IS CONTRARY TO THE LAW, NEITHER ZOOM CAR TRAVEL, NOR ANY OF ITS OWNERS, DIRECTORS, AFFILIATES, EMPLOYEES OR OTHER REPRSENTATIVES WILL BE LIABLE FOR ANY LOSS BOTH DIRECT OR INDIRECT. THEY WILL ALSO NOT BE LIABLE FOR USING ANY INFORMATION, SERVICES OR PRODUCTS AND/OR SUCH MATERIALS THAT ARE OFFERED THROUGH THE USE OF THIS BOOKING ENGINE. THIS INLCUDES, BUT IS NOT LIMITED TO LOSS OF DATA, PROFIT OR OPPORTUNITY, INCOME, LOSS OF OR DAMAGE TO PROPERTY. TERMS OF BOOKING CONDITIONS
The following information pertaining to various conditions that apply to reservations/bookings that made by you may please be read carefully, particular with regard to renting of vehicles through this booking engine
A. Zoom Car Rental has global operations and hence there are three types of payment models when you are making a booking. The same is given below:
You have the option of making a booking deposit upfront at the time of booking and balance can be paid to the rental vehicle provider on arrival or,
You have the option of paying the entire rental cost of the vehicle when you are making the booking. You can pay only for the fuel Petrol/Diesel and other charges on arrival or
You do not pay anything when you are making the booking using the booking engine. Zoom Car Rental will make the booking on your behalf without asking for any money and you agree to pay the rental vehicle provider with the entire cost of the vehicle rented once you arrive at the place of destination.
The mode of payment for the booking is totally dependent on the location and/or the type of rental vehicle provider that is chosen. As a customer you will be informed if you need to make any upfront payment before completing your booking. In cases where there is a need, you will be required to pay additional services/costs and any other service charges which may be applied by the rental vehicle provider. You can make the payment either using a credit or debit card or also through PayPal. This is for the purpose of making the introductory service payment as provided for in the booking engine. It should also be known to you that not all rental vehicle providers will accept debit cards or PayPal. You should also be aware that if your booking is cancelled less than 48 hours before the actual commencement of the travel, Zoom Car Rental will not refund the introductory service and also the booking deposit if any paid by you. If the rental amount has been paid in full, Zoom Car Rental will retain 3 days rental and the introductory service fee will not be refunded. However, it has to be noted that Zoom Car Rental will be held responsible for refunding of the rental amount and you hereby acknowledge that Zoom Car Rental has no liability to refund the total rental amount under any situation. If you wish to make any changes to your booking Zoom Car Rental must be sent a communication through Zoom Car Rental Support using the booking engine. Such communication must clearly inform Zoom Car Rental of the correct details of such changes. Zoom Car Rental, however, does not undertake any guarantee that said changes can be processed or honored, though all effort will be made to accommodate the changes required. However, changes cannot be processed once the vehicle has been collected. Furthermore, Zoom Car Rental will not be able to refund if you end your rental earlier than what you have already promised earlier. In case you wish to extent the rental period after you collected the rental vehicle (for dates not covered under the Zoom Car Rental Voucher), the payment must be made directly by you to the rental service provider at the rates prevailing at that point in time. It is also to be noted that once a booking or reservation has been made it is your responsibility to inform the rental vehicle provider if needed about the physical or mental condition regarding the rented vehicles. If an accident occurs, this could bring in insurance implications if you do not inform the rental vehicle provider of the condition. Once the vehicle has been collected, you will be required to provide the full drivers license (UK Licenses two parts) from the country or origin, a valid passport and a credit card that is valid and in the renter's name. If you fail to produce the required documents, the car rental agency can refuse the car and funds paid will be reimbursed to you. In case there is a delayed arrival, the responsibility lies of the customer to contact the car rental agent and inform about such delay. In case a flight is cancelled or delay, Zoom Car Rental shall not be held responsible for the money paid. The refunds for the same must be claimed from the holiday insurance company.
B. Confirmation of Booking
As and when you booking is confirmed, Zoom Car Rental will be issuing a confirmation of booking on behalf of the rental service provider. However, Zoom Car Rental does not undertake responsibility to include charges for additional services or other taxes charges by rental vehicle provider. Even other additional services that are requested by you as a customer at the collection point will be to your account and hence Zoom Car Rental advises you to thoroughly check the all the relevant details such as country, location, and period of rental and other such details. Should there by any discrepancies, the same should be immediately conveyed using the website booking engine, clearly informing Zoom Car Rental about the exact details of such discrepancy. Zoom Car Rental also advised that you take time to read and fully follow the rental vehicle provider's terms and conditions (this is available on this booking engine, but may be changed by the rental vehicle provider regularly). The reservation number that is a part of the bookings confirmation should be a part of all communication such as enquires modification or cancellation of booking.
C. Cancellations
If you want to cancel the booking, it must be made at least (48) hours before the vehicle is rented, pursuant to a booking that is made using this booking engine. The only way a booking can be cancelled is by using the Zoom Car Rental Website. You are advised not to cancel the booking directly, because this would entail an additional fees. If the cancellation notice is received by Zoom Car Rental inside seven (7) days of the car rental booking date and also within forty eight (48) hours before the commencement of the vehicle rental date, using this booking engine, all the funds will be given back. If the cancellation notice is received by Zoom Car Rental after seven (7) days of the car rental booking date and at least forty eight (48) hours before the commencement of such booking done through this booking engine, you will be refunded all funds except a cancellation handling/administration fee of Euro 25.00. A non-refundable Administration Charge (card processing fee) wherever applicable, will also be deducted. In case the cancellation notice is received by Zoom Car Rental less than forty eight (48) hours before the rental of the vehicle is due to commence, after the booking is made through this booking engine, no funds paid will be reimbursed, unless the entire rental amount has been prepaid. Even here, Zoom Car Rental will retain 3 days rental and Administration charge, i.e. card processing fee wherever applicable. In the event a cancellation happens when the entire amount is payable on arrival, no cancellation fee will be charged, but you should still need to cancel your reservation using the Zoom Car Rental Website.
It should also be known that the responsibility of canceling any other ancillary product that could have been purchased in conjunction with their vehicle reservation rests with the customer. In other words Loss Damage Waiver Excess Reimbursement Insurance made through third parties like insurance4carhire.
In case you cancel or change a credit/debit card booking, Zoom Car Rental will not be held responsible if any monetary loss occurs to you because of a change in monetary exchange rates from the date of your original booking and the subsequent cancellation or amendment rate.
D. Pricing
Zoom Car Rental takes every care to ensure that prices that are quoted at the time of booking using this booking engine are accurate and correct in all material respects. Nonetheless, Zoom Car Rental has the right to change or amend quote price at the time when an actual booking is made in case there is a manifest or patent error in such quoted price. Zoom Car Rental will however make all efforts to notify the customer within a reasonable period of time, if such a correction has taken place. In case there is a change in the price quoted at the time of booking the customer will be entitled to pay the difference or if he is unwilling, the customer will be entitled to a full refund of all the sums paid. Further, the foreign exchange rates used by Zoom Car Rental to display rates are changed and updated regularly. However, foreign exchange rates that are given by credit card companies can change now and then. Zoom Car Rental cannot be questioned or be held accountable for any discrepancy between the displayed price and the amount charged by the customer's credit card company because of such change in exchange rates.
E. Complaints Procedure:
All complaints must be made in writing and must be logged with Zoom Car Rental Support and must be received within a period of 30 days of completion. Any complete received after this date will not be processed or enquired into.
NO LIABILITY IN CREDIT CARD OR DEBIT CARD TRANSACTIONS
While it will be the sincere endeavor of Zoom Car Rental to ensure that all credit and debit card transactions made through this booking engine are secure, in case any unauthorized or incorrect charges appear in the customer's credit or debit card statement, for any transaction that may have been using this booking engine, Zoom Car Rental shall not be held liable for any damage or loss that the customer may have suffered because of such use, transaction or disclosure, subject only to any statutory rights that the customer may have.
